Teachers Unions and Microsoft Set AI Privacy Rules for Schools
On September 9, 2026, AFT President Randi Weingarten, United Federation of Teachers President Michael Mulgrew and Microsoft Vice Chair and President Brad Smith announced a National AI Safety and Privacy Standard for schools. Everything below comes from that first party announcement.
Transcript
Teachers unions and Microsoft announced a national AI safety and privacy standard for schools today.
The American Federation of Teachers, the United Federation of Teachers, and Microsoft announced legally enforceable protections for students, families and educators.
Companies cannot use student data to train AI models, students cannot be tracked, and AI cannot make decisions without human oversight.
Districts write these protections into their Microsoft contracts and can cancel or seek damages. This follows New York City's screens and AI ban.
This is a contract, not a law. It binds only Microsoft, and only where districts adopt it. No independent audit exists.

- "The first-of-its-kind agreement ... ensures that tech companies cannot use student data to train AI, students can never be tracked, AI cannot make decisions without human oversight, and companies must give educators and parents transparency and plain-language answers about how their tools work."(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
- "U.S. school districts can incorporate these protections directly into their Microsoft customer agreements, making them contractually enforceable." Supporting the data and control points: "Student and educator data will not be used to train AI models, sold or repurposed, and schools will maintain control over how data is used, retained and deleted."(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
- Mulgrew of the UFT is quoted saying the agreement "empowers school districts to end agreements and seek damages from bad actors who break the rules."(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
- The agreement comes "on the heels of New York City Public Schools' screens and AI ban", and the subhead states the standard "builds on NYC schools' screen and AI ban." The release adds that a similar framework was adopted "last week" by "New York City Public Schools and Mayor Zohran Mamdani."(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
- The release itself states the agreement was reached "in the absence of any meaningful federal and state rules governing artificial intelligence in schools", and quotes Weingarten saying "HIPAA and FERPA never envisioned the advent of AI." Smith is quoted saying only that Microsoft will "extend this agreement to every school district across the country", which is a commitment by Microsoft alone.(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
- Honesty caveat: this is a voluntary contractual standard negotiated between two teachers unions (the AFT and its New York City affiliate, the UFT) and a single vendor, Microsoft. It is not legislation and creates no legal duty for any other AI company. It becomes binding on a district only if that district incorporates the terms into its own Microsoft customer agreement. Microsoft is simultaneously a party to the agreement and a company selling AI products into schools, and the announcement is published on Microsoft's own newsroom. No independent party, regulator or auditor is cited as having verified, reviewed or enforced the terms. The release points to a fact sheet and the full agreement as separate linked documents; neither was fetched, so every specific term above comes only from the press release summary. No corroborating coverage was available at the time of writing: YouTube transcript research returned 0 of 5 videos.(Microsoft's official announcement, "AFT, UFT and Microsoft announce 'National AI Safety & Privacy Standard' for schools to protect students, families and educators", published September 9, 2026)
